Do you need an ITIN to form a US LLC?

Short answer

No. You do not need an ITIN, an SSN, or a US visa to form a US LLC. You can register the LLC and obtain its EIN as a non-resident. An ITIN only becomes useful later, for personal credit products and personal US tax filings, not for creating the company.

What forming an LLC actually requires

To form a US LLC as a non-resident you need a company name, a US registered agent in the chosen state, and the filing fee. None of that requires a US taxpayer number. The EIN that follows is obtained with Form SS-4 by fax or mail, again without an ITIN.

When an ITIN does help

An ITIN matters downstream: it lets you personally guarantee certain credit cards, start a personal US credit file, and file a personal US tax return if you ever need to. Think of it as widening your financial options, not as a requirement for the LLC itself.

How long the ITIN itself takes

The IRS asks you to allow 7 weeks, and 9 to 11 weeks in tax season (15 January to 30 April) or if you applied from overseas.In our own cases filed over the summer of 2026, the ITIN letter came back in about six weeks.
